FloodGate Privacy Policy
Your confidentiality is important to us, and Floodgate Medical, Inc. (“Floodgate” or “We” or “Us”) is firmly committed to protecting the privacy of the users of the Floodgate Service. We do not sell or rent your company or personal information to others. We use customer information only for the purposes of setting up your account, delivering our service, enhancing the operation of our site and administering our systems. Please read this privacy policy before using this site or any services related to it. By using the services provided both online and offline, you are bound by this policy, which may be modified from time to time. If you do not agree to and abide by this policy or any future terms, you may not use the Floodgate Service provided by Floodgate.
FloodGate is the operator of www.floodgatemedical.com, app.floodgatemedical.com and the services related to these websites (collectively referred to as the “Floodgate Service”). This Privacy Policy describes the type of information Floodgate collects when you use the Floodgate Service, what we do with that information, and how visitors can update and control the use of information using the Floodgate Service. This Policy applies solely to our online data collection from the Floodgate Service; it does not describe information collection policies for other data we collect, including data collected on other sites, such as separate sites operated by our Business Partners that we do not control.
Personal Information
“Personal Information” is information that you provide to us which personally identifies you, such as your name, email address or billing information, or other data, which can be reasonably linked to such information by Floodgate. Personal Information is different than Aggregate Non-Personal Information. “Aggregate Non-Personal Information” is information that is recorded about users and collected into groups so that it no longer reflects or references an individually identifiable user. We do not collect any Personal Information from a user of the Floodgate service unless that visitor expressly and intentionally provides it. Floodgate does not collect any Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, or sex life, unless such information is required to comply with applicable laws or regulations, such as those relating to affirmative action. If you are simply browsing the Floodgatemedical.com site, we do not gather any Personal Information about you. Floodgate may collect Aggregate Non-Personal Information that is not associated with you individually to assist Floodgate in improving the services offered through the Floodgate Service. In some instances, we may combine Non-Personal Information with Personal Information (such as embedding email addresses in cookies). If we do combine any Non-Personal Information with Personal Information, the combined information will be treated by us as Personal Information hereunder as long as it is so combined.
Electronic Resume
We provide functionality on the Floodgate Service that allows you to create an electronic profile, which includes enhanced features determined by FloodGate (each such electronic profile, a “Electronic Resume”) and post certain information and materials on your Electronic Resume. Please note that your Electronic Resume, including the Personal Information available in your Electronic Resume, may be accessible to employers when you accept an invitation for a job either directly or through an authorized recruiter. We urge you to exercise discretion and caution when deciding to disclose your Personal Information, or any other information, in your Electronic Resume. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF ANY Personal Information YOU DISCLOSE IN YOUR Electronic Resume. You should also be aware that Floodgate may categorize, arrange or summarize certain information differently for different Users of the Floodgate Service. What you see when you use the Floodgate Service may be arranged differently than and contain different information than what other users of the Floodgate Service see.
Automatically Gathered Information
Floodgate automatically collects your browser type and browser software version to tailor the presentation of the Floodgate Service to your platform and to maintain a record of your activity on the site. Floodgate uses cookies to enable Users to specify unique preferences and to track User trends and patterns. Users always have the option of disabling cookies via their browser preferences. If you disable cookies on your browser, please note that some parts of our site may not function or may be considerably slower. As an automatic process, our web server software records a log file of the Internet Protocol (“IP”) addresses that access the Floodgate Service. Your IP address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Floodgatge Service, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all users, for purposes such as calculating Floodgatge Service usage levels, helping diagnose problems with the Floodgatge Service’s servers, and administering the Floodgatge Service. We can and will use IP address to identify a User when we, in our sole discretion, determine that it is necessary to enforce compliance with our Terms of Use or to protect our service, site, customers or others. Collecting IP addresses is standard practice on the Internet and is done automatically by many web sites.
Users of the FloodGate Service
Except as described above, FloodGate does not collect or require users of the Floodgate Service to furnish personally-identifiable information. Like most website operators, FloodGate collects non-personally-identifiable information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. FloodGate’s purpose in collecting non-personally identifiable information is to better understand how FloodGate’ visitors use the Floodgate Service. From time to time, FloodGate may release non-personally-identifiable information in the aggregate, e.g., by publishing a report on trends in usage of the Floodgate Service. FloodGate also automatically collects some computer generated personally identifiable information such as your Internet Protocol (IP) addresses. FloodGate does not use such information to identify its visitors, does not link the information to other personally identifiable information about you, nor does it disclose such information to third parties, other than under the same circumstances that it uses and discloses personally-identifiable information, as described below, should you decide to identify yourself to us.
Collection and treatment of personal Information
Certain visitors to FloodGate’ website choose to interact with FloodGate in ways that require FloodGate and others to know a little bit more about them through personally-identifiable information. The amount and type of information that FloodGate gathers depends on the nature of the interaction. For example, employers wishing to fill jobs through our Floodgate Service must supply a name, company name, address, industry, company website, company size, company description, personal description, telephone number, email address, screen name, etc. Recruiters and others service and business partners who are accepted by FloodGate and become eligible to assist FloodGate in the filling of jobs must supply a name, company name, address, telephone number, fax number, email address, company website, company description, personal description, screen name, password, etc. Potential employees who are seekin jobs must provide name, alias, postal address, telephone number, email address, profession, industry knowledge, and resume information including: contact information, career summary, career objective, work history, educational history, skills, certifications, clearances, references, as well as portfolio information containing Personal Information you may want to attach in your communications including: documents, multimedia items such as video or audio clips or photographs, charts, and external links to Personal Information you wish to reference, only when you voluntarily provide it to us.
In each case, FloodGate collects information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with FloodGate. FloodGate will not disclose sensitive financial information unless required by law. FloodGate does not disclose any other type of personally-identifiable information other than as described below.
How we use your Personal Information
We may use your Personal Information in the following ways:
i. Fulfillment of Requests. FloodGate may use your Personal Information to fulfill the purpose for which such Personal Information was provided (for example to build a profile, have your education credentials certified or have a career management professional review your Electronic profile for consideration by employers).
ii. Administrative Communications. From time to time, at our sole discretion, we may use your Personal Information to send to you important information regarding the Floodgatge Service, or changes to our terms, conditions, and policies. Because this information may be important to your use of the Floodgatge Service, you may not opt-out of receiving such communications.
iii. Interests. If you choose to do so, you may receive messages from other Floodgatge Service users relating to certain areas of interest that you select. We do not provide your Personal Information to such other users – rather, the message from the user is sent to a group of people, including you, based on demographic information and the areas of interest you and the others in the group have selected, and you can decide whether to respond to the message or delete it.
iv. Internal Business Purposes. We may also use your Personal Information for our internal business purposes, such as data analysis, audits, order fulfillment tracking, enhancing our web site, improving our services and identifying usage trends.
Opt-Out
Unless you opt-out, we may share your Personal Information with third parties for their marketing purposes. If, after you have opted in, you change your mind and you no longer wish to receive marketing-related emails from us and/or you do not want us to share your email address with third parties for such third parties’ marketing purposes, you may opt-out of receiving such marketing-related emails and/or from such sharing by selecting the appropriate opt-out check box located on your ‘My Profile’ page.
We will endeavor to comply with your request as soon as reasonably practicable. Please note that if you opt-out as described above, we will not be able to remove your Personal Information from the databases of third parties with which we have already shared your Personal Information (i.e., to which we have already provided your Personal Information as of the date that we implement your opt-out request). If you wish to cease receiving marketing-related emails from such third parties, please contact such third parties directly or utilize any opt-out mechanisms set forth in their respective privacy policies or marketing-related emails.
E-mail Request for Information or Registration
We use links throughout the Floodgate Service to provide you with the opportunity to contact us via e-mail and message boards to ask questions, request information and, register or provide comments and suggestions. You may also be offered the opportunity to have one of our representatives contact you personally to provide additional information about our services. To do so, we may request additional Personal Information from you, such as your name and telephone number, to help us satisfy your request.
Mandatory Communications
Floodgate sends all newly registered members a welcome email to verify their email addresses and other registration information. At times, Floodgate sends service announcements to its registered employers and recruiters. Members cannot unsubscribe from service announcements that discuss upcoming changes that affect their Floodgate accounts. In addition, we communicate with registered members via personal emails, messages or phone calls to provide requested services.
Links to Other Sites
Floodgate is not responsible for the privacy practices or the content of any other web sites to which the site links or which link to the site. By clicking on a link, logo or other item, please note that you may no longer be on the Floodgatemedical.com site. To check what Internet location you are on, note the URL at the top and/or bottom of your browser. We encourage you to read the posted privacy statement of that web site whenever interacting with any site.
Law enforcement; Emergencies; Compliance.
Notwithstanding any other provision of this Policy to the contrary, we reserve the right to disclose your Personal Information to others as we believe to be appropriate (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests; (d) to enforce our Terms of Service; (e) to protect our operations; (f) to protect the rights, privacy, safety or property of FloodGate, you or others; and (g) to permit us to pursue available remedies or limit the damages that we may sustain.
Third Party Service and Business Partners
Floodgate may engage third-party intermediaries to provide our members with additional offerings and services. Floodgate makes no representations regarding these third parties and their use of Personal Information. Please refer to the third-party’s web site and terms of service for their specific privacy policies.
Children
The Floodgate Service is not intended for children under 18 years of age. We do not knowingly collect personal information from anyone under 18.
Account Protection
Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your Floodgate password to anyone. If you do share your password or your Personal Information with others, remember that you are responsible for all actions taken in the name of your account. If your password has been compromised for any reason, you should immediately notify Floodgate and change your password.
Updating and Correcting Information
Most User Information is User updatable in the My Profile section of the Floodgatemedical.com site. If you cannot update the information yourself, please submit a help ticket to notify us of any changes or errors related to any of your information that we have on file. Upon receipt of such requests, we will update our files within 30 days.
Security
Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use tools (encryption, passwords, physical security, etc.) to protect your Personal Information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your Personal Information that they collect from the site. We will use commercially reasonable methods to keep Personal Information securely in our files and systems. Please note that with current technology, we cannot guarantee the security of your data as it travels over the Internet. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section. Please note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem.
Changing or Removing Your Personal Information
If you would like to review, correct, update or remove Personal Information that you have previously provided to us through the Floodgate Service, you may do so by visiting the following locations within the Floodgate Service: 1) ‘My Profile’ located on the ‘My Profile page and 2) Contact Information within the Resume Sections area of each electronic profile that you create.
Please note that we may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed therefrom. We also reserve the right, from time to time, to re-contact former users of the Floodgate Service. Finally, we are not responsible for removing information from the databases of third parties with whom we have already shared your Personal Information.
Profiles
As part of registration, you will provide specific information about your organization. Some of the information requested in the registration is mandatory. We strongly encourage you to complete your entire profile as this may directly affect your outcome.
International Users
Though we make every effort to preserve User privacy, we may need to disclose your Personal Information when required by law when we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process.
Assignment
We reserve the right to transfer any and all information that we collect from Floodgate Service users to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of FloodGate’s business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).
Terminating Your account
We save your Personal Information until your account with us is terminated. To terminate account, submit a help ticket indicating your request. If you terminate your account, your Personal Information cannot be recovered and you may continue to receive email communications for a short period of time until we have updated all of our databases. After terminating your account, your Personal Information may remain on our archived database and records for a reasonable time as residual information. We will not use this residual information. Notwithstanding the above, we will maintain information on Users who have been removed for violating any of our agreements.
